COMMITMENT TO YOU is to protect personal
information that you provided to us regarding your real
estate loan transaction. We are aware that you have
concerns with what we do with this information. We have
put into place this Privacy Policy to govern the handling
and use of your personal information.
NON-PUBLIC INFORMATION
that we may collect will include as follows:
• Information we receive on your loan application,
whether in person, in writing, by telephone or by any
other means.
• Information you provide to us or give authorization
for another party to provide to us with reference to
obtaining your real estate loan. Such information can
include but not limited to copies of paycheck stubs,
federal income tax information, financial institution
statements to verify assets, mortgages or any other
information we request that is necessary for the loan
transaction that you fully agree to provide us with.
• Information from affiliated companies that is
necessary for the loan transaction such as appraisers
and credit reporting agencies.
INFORMATION THAT WE
COLLECT OF PUBLIC RECORD is from title/escrow
companies and this will be information pertaining to
you and the subject property. If deemed necessary, it
may also include information on other properties you
may own. Once you have closed your loan transaction
with our company and the new loan is recorded with the
county recorder’s office, it will become of public
record.
HOW DO WE USE THIS
INFORMATION? The information we gather
on you for the purpose of obtaining a real estate loan
is not for the benefit of any nonaffiliated party. We
will not release your information to any non-affiliated
parties except when:
• As deemed necessary for us to provide the product
or service you have requested from us.
• As the law permits.
AFTER YOUR LOAN RECORDS,
your loan file is placed in storage in a designated
safe area for the maximum time as per any federal and
state agencies that govern us. This includes our licensing
agencies being The Department of Real Estate for the
State of California and The California Department of
Corporations. Once we have reached the maximum time
of physically securing your loan file, we have a fully
bonded/insured shredding company shred your file at
the premises where your files are stored. We also have
a shredding machine located at each office. However,
your information may be used for internal purposes such
as quality control or auditing purposes. You may also
be contacted by one of our Customer Service Representatives
or a Loan Officer for the sole reason of keeping you
informed of other real estate loan programs that may
be useful information for your benefit.
CONFIDENTIALITY AND
SECURITY is our promise to you. We will
use our very best efforts to ensure that your personal
information is protected from unauthorized parties.
We have an in house Safeguard Rule/Financial Privacy
Policy that set the guidelines and standards to every
staff member employed at Western Heritage Financial.
We hold regular staff meetings where we educate our
employees on the responsibilities of handling your loan
information in accordance with protecting your privacy.
All of your personal loan information is put into our
computer system without Internet access as a means of
processing your loan request for the investor. Every
office computer is only accessible by use of a password.
Each staff member has his or her own individual password.
If a staff member is terminated or leaves the company,
their password is immediately deleted and access to
our computer system is terminated. To guard your non-public
personal information, we have in place physical, electronic
and procedural safeguards to comply with federal regulations.
